Eligible entrants

Entry is open to residents of New Zealand aged 18 years or over at the time of entry.

Entrants must hold a genuine, personal [Instagram and/or Facebook] account, and that account must be set to public (not private) for the entrant to be eligible.

Persons excluded under clause 3 of the General Terms are not eligible to enter.

How to enter

To enter, the entrant must, during the Promotional Period:

Each entrant must ensure their account privacy setting is set to public (not private) to be eligible.

Winner determination

This is a game of chance. Skill plays no part in determining the winners.

All valid entries received during the Promotional Period will be entered into a single random electronic draw, to be conducted at [insert draw address] on [DD/MM/YY] at [00:00am/pm] NZ[ST/DT].

The first [500] valid entries drawn will each win one (1) prize as set out below.

Prize conditions

The winner will be asked to nominate a size from those available at the time of claim, subject to availability, and the Promoter may substitute the nearest available size.

The prize will be delivered to a New Zealand physical delivery address nominated by the winner. Delivery to a PO Box or to an address outside New Zealand is not available. Delivery is expected within [five] days of the winner providing valid delivery details.

Winner notification

Each winner will be notified by direct message to the [Instagram/Facebook] account used to enter, within [insert number] days of the draw.

Unclaimed prizes

Stage two: if a prize is not claimed by that time, the Promoter will conduct an unclaimed prize redraw on [DD/MM/YY] at [00:00am] NZ[ST/DT], using the same method as the original draw.

General Terms

1.  Acceptance of these Conditions

By entering this Promotion, each entrant agrees that they have read, understood and accepted these Conditions of Entry, including the Schedule. Entry into the Promotion constitutes acceptance of these Conditions of Entry. Capitalised terms have the meaning given to them in the Schedule unless otherwise stated.

2.  Promotional Period

The Promotion commences on the start date and concludes on the end date specified in the Schedule (the “Promotional Period”). Entries are deemed to be received at the time they are received by the Promoter, and not at the time of transmission or submission by the entrant. The records of the Promoter and its agencies are final and conclusive as to the time of receipt.

3.  Who may not enter

The following persons are not eligible to enter: employees, and the immediate family members of employees, of the Promoter, of any company or agency directly associated with the conduct of this Promotion, of any business involved in determining the winners or in the management of the Promotion, of any organisation benefiting from the Promotion, and of the Promoter’s distributors, suppliers, subsidiaries, related companies and agencies.

“Immediate family member” means a spouse, ex-spouse, de facto partner, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

4.  Free entry - no purchase necessary

Entry into this Promotion is free and no purchase is necessary. The Promoter charges no entry fee. The only cost to an entrant is any charge levied by their own internet or mobile service provider for accessing the relevant platform, which is no greater than that provider’s ordinary charge.

The parties record that this Promotion is a sales promotion scheme and is not gambling for the purposes of the Gambling Act 2003. No permit, licence or authority is required to conduct this Promotion in New Zealand.

5.  Game of chance

This Promotion is a game of chance. Winners are determined at random and chance alone determines the outcome. No skill, judging criteria or assessment of entries is used in selecting the winners.

6.  Winner notification and reasonable efforts

The Promoter will make all reasonable attempts to contact each winner using the contact details associated with the account used to enter. The Promoter is not responsible for a winner’s failure to receive, read or respond to a notification, including where the notification is filtered into a message request folder, where the account has been deactivated or renamed, or where the entrant’s privacy settings prevent the message being delivered.

7.  Prize forfeiture

If a winner does not claim a prize by the time specified in the Schedule, chooses not to take the prize, is unable to take the prize, or cannot be contacted, the prize is forfeited. The Promoter is not obliged to substitute the prize or to provide any compensation for a forfeited prize, and may deal with the prize in accordance with the unclaimed prize provisions in the Schedule.

8.  Ancillary costs

Any ancillary or incidental cost associated with claiming or using a prize is the responsibility of the winner and is not included in the prize. Where a prize includes a voucher, credit or gift card, any unused balance will not be awarded as cash, and redemption is subject to the terms and conditions of the issuer.

9.  Prize value

The value of each prize is based on the recommended retail value of that prize, inclusive of GST, as at the date these Conditions of Entry were prepared. The Promoter accepts no responsibility for any variation in the value of a prize after that date. All values are in New Zealand dollars.

10.  Prize substitution and transferability

No prize, and no part of a prize, is transferable, exchangeable or redeemable for cash, unless the Promoter specifies otherwise in writing.

If a prize or any part of a prize becomes unavailable for a reason beyond the Promoter’s reasonable control, the Promoter reserves the right to substitute it with a prize of equal or greater value and specification.

11.  Disputes as to identity

If there is a dispute as to the identity of an entrant or a winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner, or to invalidate the entry. Where an entry is made through a social media account, the authorised account holder at the time of entry is deemed to be the entrant.

12.  Third party prizes

Where a prize or any part of a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of that third party supplier, and the supply and fulfilment of the prize is the responsibility of that third party. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, for any variation in the prize, or for any failure by the third party to meet its obligations in connection with the prize. To the extent of any inconsistency, the third party’s terms and conditions prevail over these Conditions of Entry in respect of the prize.

Nothing in this clause limits any right the winner has against the Promoter or the third party under the Consumer Guarantees Act 1993.

13.  Statutory rights

Any guarantee or warranty given in relation to a prize is in addition to, and does not limit, the statutory guarantees and rights an entrant has under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Conditions of Entry excludes, restricts or modifies, or purports to exclude, restrict or modify, any right or remedy that cannot lawfully be excluded, restricted or modified.

14.  Privacy

15.  Publication of winners

For the purposes of public statements and advertising, the Promoter may publish a winner’s first name, the first letter of their surname and their town or city of residence.  By entering the Promotion, entrants consent to that publication.

16.  Entry content

The Promoter may determine all entries invalid and/or preclude participation by an entrant if an entrant disrupts, annoys, abuses, acts contrary to law or engages in fraudulent or misleading and deceptive conduct.

 It is a condition of participating in the Promotion that the entrant warrants that their entry is original and does not infringe the intellectual property of any third parties. The entrant assigns all rights, title and interest in their entry to the Promoter without compensation. The entrant further agrees not to object to the Promoters use of the entry material on the basis of any moral right. The Promoter may, if required request that an entrant complete any documentation necessary to give effect to this assignment of right, title and interest.

The Promoter may adapt and use any entry content for publicity and promotion purposes for an unlimited time throughout the world without compensation in any media, social media, advertising and/or promoting any goods or services of the Promoter.

The Promoter may remove, or decline to publish, any entry or part of an entry that breaches this clause, and will have no liability to the entrant for doing so.

17.  Validation and invalid entries

The Promoter reserves the right, at any time, to validate and verify the authenticity of entries and of entrants’ details, including an entrant’s identity, age and place of residence. Entrants must provide any proof reasonably requested by the Promoter. If a winner cannot provide proof that satisfies the Promoter, the entry may be deemed invalid and the prize awarded to another entrant.

Incomplete, indecipherable, illegible or incorrect entries, and entries that breach these Conditions of Entry, will be deemed invalid. The use of automated entry software, bots, multiple or fake accounts, or any other mechanical or electronic means that allows an individual to enter repeatedly, is prohibited and may render all entries submitted by that individual invalid.

18.  Disqualification

The Promoter reserves the right to disqualify any entry, or any entrant, that breaches these Conditions of Entry or that otherwise interferes with the fair and lawful conduct of the Promotion.

19.  Disruption, cancellation and force majeure

To the extent permitted by law, if for any reason this Promotion is not capable of running as planned — including by reason of computer virus, communications network failure, bug, tampering, unauthorised intervention, fraud, technical failure, or any event beyond the Promoter’s reasonable control including war, terrorism, state of emergency, natural disaster, epidemic or government direction — the Promoter may in its reasonable discretion cancel, terminate, modify or suspend the Promotion, invalidate any affected entries, or modify or substitute a prize.

The Promoter will not exercise that discretion in a way that deprives entrants of a prize that has already been won and validly claimed.

20.  Liability

Except for any liability that cannot be excluded by law (in which case the Promoter’s liability is limited to the minimum permitted by law), the Promoter and its associated agencies and companies are not liable for any loss, damage, expense, personal injury or death, including indirect, special or consequential loss or loss of profits, suffered or sustained in connection with this Promotion or with accepting or using any prize, whether or not arising from any person’s negligence.

Nothing in this clause limits any right an entrant has under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where the entrant is a consumer.

21.  Right to refuse participation

The Promoter reserves the right, in its absolute discretion, to refuse to allow a winner to take part in any aspect of a prize if the Promoter reasonably determines that the winner is not in the physical or mental condition necessary to participate in or accept the prize safely. It is a condition of accepting a prize that the winner may be required to sign a legal release in a form determined by the Promoter.

22.  Marketing and publicity

Each winner agrees to participate in reasonable marketing, publicity and editorial activity relating to the Promotion, which may include being photographed, filmed, recorded or interviewed. The Promoter may use that material for marketing, publicity and promotional purposes in any media without further reference, payment or compensation, subject to the winner’s rights under the Privacy Act 2020.

23.  Tax

The Promoter accepts no responsibility for any tax implications arising from participating in this Promotion or from accepting a prize. Entrants should seek independent advice about the tax implications of accepting a prize.

24.  No waiver

A failure by the Promoter to enforce any of its rights under these Conditions of Entry at any time does not constitute a waiver of those rights.

25. Social Media

The Promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Instagram or TikTok. Entrants completely release Facebook, Instagram or TikTok from any and all liability relating to the Promotion (this release is a requirement of the operators of Facebook, Instagram and TikTok).

26.  Governing law

This Promotion and these Conditions of Entry are governed by the laws of New Zealand, and the entrant and the Promoter submit to the non-exclusive jurisdiction of the courts of New Zealand.
